A good book to understand the evolution of today's immigration law.Americans might be under the perception that until recently, we have always closely guarded our borders and regulated entrants who mostly "came here legally" by adhering to immigration law.But as Salyer's work points out, America's immigration law developed over time. She uses the experience of immigration law vis-a-vis Chinese immigrants in the late 1800s to make a couple points. First, immigration law within the context of regulatory agencies responsible for its administration, arose in the late 1800s. Second, that early regulation was aimed at keeping out ethnically or socially undesirable groups like the Chinese, who were otherwise migrating in accordance with American practice. And finally, that the expansion of immigration regulation was based upon the Chinese experience and soon applied to other less-than-desirable groups.Laws Harsh as Tigers gives a revealing look at the rise of immigration law. It forces us to rethink the idea of "sovereign borders" and to reflect back on when immigration was part of the common law. Only later did the idea of an administrative system, largely separated from and independent of, the court system, develop. With this, the American government gained much power to formulate, administer and interpret immigration law--as the author would argue, to the detriment of the rights of immigrants.In the first part, the book provides a look into how Chinese immigrants faced new restrictions and how they fought back using the courts. Eventually new laws and self-guided administrative procedures restricted this route to them. The second part of the book catalogs the development of administrative law in immigration. It shows how immigration restrictionists, often those within the immigration bureaucracy itself, used the powers of administration to shape immigration.Both halves should give the reader insight into the creation of immigration law, the emergence of restrictive immigration policy, and how both fit into the expansion of the national government in the late 1800s and early/mid 1900s.

This is the definitive history of the legal struggle against the Chinese Exclusion laws that banned almost all Chinese nationals from entering the United States between 1882 and 1943. It shows the racist underpinnings of the legal doctrine that today that limits rights of all of us, citizens and non-citizens at the border. At the same time, it shows the power of an organized legal resistance, and the ways the judicial branch maintained its adherence to the rule of law in the face of bigotry. Salyer documents that Chinese brought over 7,000 cases challenging the laws and their implementation in the first decade of exclusion, and were so successful that Congress ultimately stripped courts of the power to review many exclusion decisions. As--or more--relevant to current political and legal fights as when it was published, this is a must read for those interested in immigration, law, policy, and democracy.
